Civil and Commercial Litigation

Debt Restructuring, Liquidation and Receivership

We advise regularly on debt restructuring exercise including property set-offs and settlement via issuance of private debt securities and other securities. Our experience in this area includes:

Negotiating, structuring and drafting of restructuring schemes i.e. schemes of arrangement under the Malaysian Companies Act 2016 including application for restraining order, vesting order and other ancillary orders.

Companies liquidation and receivership including voluntary winding up (including members’ and creditors’ winding up) and winding up through court order including other interlocutory proceedings such as appointment of private liquidator.

Employment Law

We regularly advise on employment law, including drafting of contracts of employment and service agreements, preparation of manuals and handbooks, dealing with redundancies and terminations and drafting of compromise agreements. We represent both employers and employees in all aspects of employment law, whether contentious or non-contentious.

Construction Contracts

We are well versed and are able to provide the necessary technical and legal advise for parties entering into any Construction Contract and are actively engaged in proceedings involving the Construction Industry Payment and Adjudication Act 2012(CIPAA 2012) which offers speedy dispute resolution of payment disputes under construction contract via Statutory Adjudication. With our wealth of experience in this area Adjudication can be an efficient manner of resolving payment disputes in the construction industry.

We deal with all aspects of commercial law, from the establishment and administration of companies, vetting of company articles, shareholders agreements and trading agreements, to dealing with litigation and disputes, debt recovery, and insolvency.
